Terms of Service

These terms apply when you engage Cairns Web Development ("we", "us") to design, build, host or maintain a website or web application. By accepting a quote or paying a deposit, you agree to them.
1. Quotes and scope
Every project starts with a written quote setting out what is included, what it costs and roughly how long it will take. That quote is the scope of work. It is valid for 30 days from the date we send it.
Work outside the agreed scope is quoted separately before it begins. We will not add charges to an invoice for work you have not agreed to.
2. Payment
- A 50% deposit is payable before work starts, unless the quote says otherwise.
- The balance is payable on completion, before the site is moved to your live domain.
- Invoices are due within 7 days of issue.
- Ongoing services such as hosting and care plans are billed in advance for the period stated in your quote.
If an invoice remains unpaid 14 days past its due date we may suspend work and, for hosted sites, suspend the service until the account is settled. We will always contact you before doing either.
3. What we need from you
Projects depend on content: text, images, logos, product details, and access to domains or existing accounts. Delays in supplying these move the delivery date.
You confirm that any material you give us is yours to use, or that you hold the necessary licence to use it. You remain responsible for the accuracy of content you supply, including prices, claims and credentials.
4. Revisions and approval
Your quote states how many rounds of design revisions are included. Further rounds are charged at our hourly rate, quoted before we proceed.
Once you approve a design or a completed build in writing, that approval is the agreed deliverable. Changes after approval are treated as new work.
5. Ownership
On final payment, you own the website: the code we wrote for you, the design, the content, and the domain and hosting accounts in your name. We will hand over whatever is needed to move the site elsewhere if you ever want to.
We retain ownership of any general-purpose tools, libraries or components we built before your project and reuse across clients. You receive a perpetual licence to use those as part of your site.
Third-party software used in your site (fonts, plugins, services) remains subject to its own licence. We will tell you about anything that carries an ongoing cost.
6. Showing your project in our portfolio
We may show your completed site in our portfolio and demo gallery unless you ask us not to. Tell us at any time and we will remove it.
7. Hosting and care plans
Where you buy hosting or a care plan from us, we will make reasonable efforts to keep your site available and up to date. We do not guarantee uninterrupted service: outages can be caused by upstream providers, networks and events outside our control.
Care plans run month to month unless stated otherwise. Either of us may cancel with 30 days' written notice. On cancellation we will provide a copy of your site files and database.
8. Your responsibilities
- Keep your own login details secure and do not share them.
- Do not use a site we build to host unlawful content, malware, or material you do not have the rights to.
- Tell us promptly if you believe your site has been compromised.
9. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, which cannot be excluded.
Subject to that, our liability for any claim connected with a project is limited to re-supplying the services, or refunding the amount you paid us for the part of the work the claim relates to. We are not liable for indirect or consequential loss, including lost profits or lost business.
10. Ending a project
Either of us may end a project in writing. If you end it, you pay for the work completed to that point and keep what has been delivered. If we end it, we refund any amount you have paid for work not yet done. See our Refund Policy for how that is calculated.
11. Changes to these terms
We may update these terms. The version that applies to your project is the one published when you accepted your quote. We will tell you directly about any change that affects an ongoing service you buy from us.
12. Governing law
These terms are governed by the laws of New South Wales, Australia.
